§1 Applicability to Entrepreneurs and Definitions

(1) The following General Terms and Conditions apply to all deliveries between us and a consumer in the version valid at the time of the order.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly not attributable to their commercial or self-employed professional activity (§ 13 BGB - German Civil Code).

§2 Conclusion of Contract, Storage of Contract Text

(1) The following regulations regarding the conclusion of the contract apply to orders placed via our online shop http://www.koi-waves.com.

(2) In the event of the conclusion of a contract, the contract is concluded with:

(3) The presentation of goods in our online shop does not constitute a legally binding contractual offer on our part, but is merely a non-binding invitation for the consumer to order goods. By ordering the desired goods, the consumer submits a binding offer to conclude a purchase contract.

(4) When an order is placed in our online shop, the following rules apply: The consumer submits a binding contractual offer by successfully completing the order process provided in our online shop.

The order is placed in the following steps:

1. Selection of the desired product

2. Confirming by clicking the “Order” button

3. Reviewing the details in the shopping cart

4. Clicking the “Checkout” button

5. Registering in the online shop after creating an account and entering login details (email address and password)

6. Final review and possible correction of the entered data

7. Binding submission of the order by clicking the “Place order with obligation to pay” or “Buy” button

Before submitting the order, the consumer can return to the page where the customer’s details are entered by using the “Back” function in their internet browser and correct any input errors, or cancel the order process by closing the internet browser. We confirm receipt of the order immediately with an automatically generated email (“Order Confirmation”). With this confirmation, we accept the consumer’s offer.

(5) Storage of Contract Text:

We store the contract text and send you the order details and our General Terms and Conditions by email. You can access the General Terms and Conditions at any time at http://www.koi-waves.com. You can also view your past orders in the customer section under “My Account” → “My Orders”.

§3 Prices, Shipping Costs, Payment, Due Date

(1) The stated prices include all other price components. Additional shipping costs may apply. Due to the small business regulation, Koi-Waves is exempt from VAT under §19 UStG, meaning no VAT is charged.

(2) Consumers can pay via PayPal or credit card (Visa, Mastercard, American Express).

§4 Delivery

(1) Unless otherwise clearly stated in the product description, all items offered by us are ready for immediate shipment. Delivery takes place within a maximum of 5 working days. The delivery period begins:

• For advance payment: the day after the payment order is placed with the bank

• For other payment methods: the day after the contract is concluded

If the delivery period ends on a Saturday, Sunday, or public holiday, it will be extended to the next working day.

(2) The risk of accidental loss or deterioration of the goods only passes to the consumer upon receipt of the goods.

§5 Retention of Ownership

We retain ownership of the goods until full payment of the purchase price has been received.

§6 Consumer Right of Withdrawal

Consumers have the right to withdraw from this contract within 14 days without providing any reason.

Withdrawal Policy

The withdrawal period is 14 days from the date on which you or a third party named by you, who is not the carrier, took possession of the goods.

via a clear statement (e.g., a letter sent by post, fax, or email) about your decision to withdraw from this contract. You may use the attached sample withdrawal form, but it is not mandatory.

Consequences of Withdrawal

If you withdraw from this contract, we must refund all payments received from you, including delivery costs (except for additional costs resulting from choosing a different delivery method than the cheapest standard delivery offered by us), immediately and at the latest within 14 days from the date on which we received your withdrawal notice.

For the refund, we will use the same payment method that you used in the original transaction unless explicitly agreed otherwise. You will not be charged any fees for this refund.

We may withhold the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.

You must return the goods immediately and, in any event, no later than 14 days from the date you notify us of your withdrawal. The deadline is met if you send the goods before the 14-day period expires.

You bear the direct costs of returning the goods.
